Probate Process

·      File Petition, Duties & Liabilities, Notice of Hearing

·      Receive hearing date: at least one month out, further depending on the court’s schedule

·      Publish Petition in local newspaper

·      Petition granted, receive Order from the court

·      Inventory & Appraisal to probate referee

·      Notices to Franchise Tax Board and Department of Health

·      Affidavit(s) of Death regarding real property

·      Obtain tax id number for the estate

·      File Petition for Approval of Final Distribution

·      Receive hearing date

·      Petition granted, receive Order from the court

·      Make final distributions


Statutory Fees

Statutory fee schedule established by the California Probate Code for determining attorney’s fees. The fees are based on the fair market value of the assets that comprise the estate and does not take liabilities into account. The current Schedule is:

  • 4% of the first $100,000
  • 3% of the next $100,000
  • 2% of the next $800,000
  • 1% on the next $9,000,000
  • 0.5% on the next $15,000,000
